These Terms & Conditions apply to all orders and purchases made through our online shop at shop.heidelberg-performance.com.
Our products are digital products, including downloadable or electronically accessible PDF protocols, guides, and informational materials.
- Contracting Parties
The contract is concluded between the customer and HPP Heidelberg Performance Protocols GbR.
Customers may be consumers or businesses. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
- Products
We sell digital informational products in the field of human performance, appearance optimization, lifestyle optimization, and general self-improvement.
The exact content, scope, and features of each product are described on the respective product page.
Our products are provided digitally only. No physical goods are shipped.
- Conclusion of Contract
By placing an order through the checkout process, the customer submits a binding offer to purchase the selected digital product.
Before submitting the order, the customer can review and correct the order details.
The contract is concluded once we accept the order by confirming the purchase or by providing access to the digital product.
- Prices and Taxes
All prices are final prices.
Any applicable taxes, fees, or charges are displayed during checkout where required.
If HPP Heidelberg Performance Protocols GbR applies the small business regulation under Section 19 UStG, VAT will not be charged or shown separately.
- Payment
Payment is due immediately upon conclusion of the contract.
The available payment methods are displayed during checkout. Depending on availability, these may include payment by card, PayPal, or other electronic payment methods.
Access to the digital product may be provided only after successful payment.
- Delivery of Digital Products
Delivery is made digitally.
After successful payment, the customer receives access to the purchased digital product, for example by download link, account access, email, or another electronic delivery method.
No physical delivery takes place.
The customer is responsible for providing a correct email address and ensuring that they can access the digital product.
- Right of Withdrawal for Digital Content
Consumers residing in the European Union may generally have a statutory right of withdrawal.
For digital content that is not supplied on a physical medium, the right of withdrawal may expire once the performance of the contract has begun, provided that the customer has expressly agreed that we begin performance before the expiry of the withdrawal period and has acknowledged that this causes the loss of the right of withdrawal.
Further details are set out in our Refund & Withdrawal Policy.
- Refunds
Due to the nature of digital products, refunds are generally not offered once access to the purchased digital product has been provided.
This does not affect any mandatory statutory rights.
Further details are set out in our Refund & Withdrawal Policy.
- Usage Rights
All digital products are protected by copyright.
The customer receives a simple, non-exclusive, non-transferable right to use the purchased digital product for personal use only.
The customer is not permitted to copy, reproduce, distribute, resell, share, upload, publish, sublicense, modify, or otherwise make the product available to third parties without our prior written consent.
This includes sharing the product in private groups, online communities, file-sharing platforms, social media, or with other individuals.
- Intellectual Property
All content, designs, texts, graphics, product names, brand elements, protocols, and materials provided by HPP Heidelberg Performance Protocols are protected by copyright and other intellectual property rights.
Any unauthorized use may result in legal action.
- Informational Purpose / No Medical Advice
Our products are provided for informational and educational purposes only.
They do not constitute medical advice, diagnosis, treatment, therapy, or a substitute for consultation with a qualified healthcare professional.
Customers should consult a qualified medical professional before making significant changes to their health, nutrition, supplementation, training, or lifestyle routines, especially if they have existing medical conditions or take medication.
- No Guarantee of Results
Individual results may vary.
We do not guarantee specific results, improvements, outcomes, or effects from using our digital products.
The implementation of any information provided is at the customer’s own responsibility.
- Technical Availability
We aim to provide reliable access to our digital products.
However, temporary interruptions may occur due to maintenance, technical issues, hosting provider issues, or circumstances beyond our control.
If the customer experiences technical problems accessing a purchased product, they should contact us at office@heidelberg-performance.com.
- Limitation of Liability
We are liable without limitation for damages caused intentionally or by gross negligence, as well as for injury to life, body, or health.
In cases of slight negligence, we are only liable for breaches of essential contractual obligations. In such cases, liability is limited to foreseeable, typical damages.
Any further liability is excluded to the extent permitted by law.
- Customer Obligations
The customer must provide accurate and complete information during the order process.
The customer must ensure that access credentials, download links, or purchased digital products are not made available to unauthorized third parties.
- Governing Law
The laws of the Federal Republic of Germany apply.
If the customer is a consumer and mandatory consumer protection laws of the customer’s country of residence provide more favorable protection, those mandatory provisions remain unaffected.
- Consumer Dispute Resolution
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
- Final Provisions
If any provision of these Terms & Conditions is or becomes invalid, the validity of the remaining provisions remains unaffected.
